Standard of Care
CDR+A will perform the Scope of Work (SOW) set forth using the degree of skill and care ordinarily exercised under similar conditions by reputable members of CDR+A’s profession practicing according to industry standards in a similar locality at the time of performance. NO OTHER WARRANTY, EXPRESS OR IMPLIED, IS MADE OR INTENDED, AND THE SAME ARE SPECIFICALLY DISCLAIMED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Any claim that Client may bring against CDR+A with respect to the Services to be performed must be commenced within one (1) year after the date on which Client first knew or should have known of the deficient Services upon which the claim is based.
Payment
Client will pay CDR+A for performing the Services as outlined on estimate or proposal with invoices due upon receipt.
Site Responsibility
Client will provide CDR+A with access to the Site and all available Site information deemed necessary to provide services. Services do not include supervision or direction of the means, methods or actual work of any party not retained by CDR+A. Client agrees that each party is solely responsible for its working conditions and safety on site. It is agreed CDR+A is not responsible for safety or security at the Site, other than for CDR+A’s employees, and that CDR+A does not have the right or duty to stop the work of others.
Excusable Delay
CDR+A will not be in breach of this Agreement due to any delay or failure to perform any obligation pursuant to a schedule if such delay or schedule failure results from circumstances beyond the control of CDR+A. In the event of any such delay, CDR+A will be entitled to an extension of the time to put the performance of the Services back on schedule, and CDR+A will be compensated for any necessary and reasonable increased costs of performance that result from such delay.
Limitation of Liability
Client agrees that the liability of CDR+A, its parent, subsidiaries, affiliates, and subcontractors, including their respective officers, directors, employees, agents, successors, and assigns for any and all causes of action whatsoever, arising out of or in connection with this agreement shall be limited to the amount of the fee paid for said services (this amount includes amounts paid to secondary clients or other third parties, attorney’s fees and all other litigation costs and expenses if any). The only exception to this liability limitation is for those causes of action for bodily injury (including death) and/or property damage occurring as a result directly related to the performance of CDR+A during its work. All third-party beneficiaries to this agreement, if any, are intended to be and are hereby bound by the terms of this liability limitation.
Client Information Required
Please provide site information and any other documentation for the design or evaluation of the Project. If applicable, please provide AutoCAD or PDF compatible plans. Changes in or delays to the above-requested information may affect the schedule and scope of this project.
Additional Services
Required engineering design work, construction administration, additional site visits, or required.
- Meeting attendance because of changes to the requirements or additions to our proposed scope will be billed as additional
- End-user changes to the design after the finalized design has been provided to CDR that requires structural changes in design will be considered additional services and billed accordingly.
No additional services work or billing will be performed without the consent and approval of the client.
Installation Verification or Repair Verification
If installation or repair verification is requested or required by any party, additional fees apply.
Third-party Payment
If the Client intends for another party to pay for the final repair verification letter, Client must provide a written notice to CDR+A stating such before CDR+A will engage in final repair verification services.
For Structural Engineering Evaluation Services
Fee schedule
The fee estimate is subject to change based on the engineer's determination of the scope of work upon assessment of site conditions at the time of the evaluation service. The fee is due at the time of the site visit in the form of cash, check or credit card. CDR+A performs the site visit and evaluation as a paid service. The information obtained from this service is solely the property of CDR+A until full payment has been received. Delivery of the written report may be delayed by the time elapsed between the site visit and payment.
The fee includes the initial site visit and assessment, and a report which includes photographs, observations, conclusions, and recommendations for repair as required. In some cases, an engineering drawing is required to specify the proper repairs and for submission to the local building officials. In certain cases, a drawing is a requirement of the NC Dept. of Insurance or local building jurisdictions. If drawings are required, the fee will be determined by the engineer based on the scope of work.
Repair Verifications of required repairs not found in the prescriptive Residential Code
If helical or push piers, new concrete footings, Engineered Beam or other similar repairs are required that are not found in the prescriptive Residential Code, the local building official will require a final repair verification letter by the Engineer of Record (EOR) for the project. The installation/repair must not be covered up or obstructed so that CDR+A may view it to provide a final repair verification letter. This is to protect the interests of the Client and satisfy all building authorities.
Scope of Structural Engineering Design Services
CDR will provide Professional Structural Engineering Design services for the project stated above. The following will be included in the scope of work:
- Professional Structural Engineering Design services
- Annotation of Structural Engineering Design on client-provided AutoCAD or PDF compliant files
- Sealed and signed structural engineering plans in PDF format to allow the client to print unlimited hard copies at any wide-format printer to be used along with architectural and mechanical plans.
- Changes or revisions to the design as required by the local building authority to complete the permitting of the plans.
Note: CDR will be responsible for necessary changes due to errors or oversight of CDR.
Exclusions from the Scope of Design Proposals
Items excluded from the scope of this proposal include, but not limited to, the following:
- Site visits or meetings are not part of the scope of this proposal but can be provided if requested.
- Changes to the design due to modifications by the client, the residential designer or architect, or builder after structural engineering design work has begun.
Forms required by the county/city/other officials.
Structural Engineering Sign Design
The fee includes assessment and design for a foundation/attachment of the above-mentioned sign(s). A final report / an 8.5x11 engineers sketch with construction specifications will be provided in PDF format with PE Seal for permit use. The authority having jurisdiction may require an engineer’s drawing. This can be provided for an additional fee.
Structural Engineering Dock Design
CDR will provide Professional Structural Engineering Dock Design services for the project stated above. The following will be included in the Scope of Work (SOW).
- Professional Structural Engineering Dock Design based on client-provided information.
- Seals and signed structural engineering plans in PDF format will be provided for permit use.
- Changes or revision as required by the local building authority to complete permitting.
Note: CDR+A will be responsible for necessary changes due to errors or oversight of CDR+A.
